1. Introduction and Acceptance of Terms

Welcome to 49jil (hereinafter referred to as "the Platform," "we," "us," or "our"), an online gaming and sports betting platform operated under the regulatory authority of the Philippine Amusement and Gaming Corporation (PAGCOR). The Platform is accessible at the domain 49jil.cam and through associated mobile applications. These Terms and Conditions (hereinafter "Terms") govern your access to and use of all services, features, content, and products offered through the Platform.

By registering for an account, accessing the Platform, placing bets, participating in games, or otherwise using any of our services, you expressly acknowledge and agree that you have carefully read, fully understood, and voluntarily accepted these Terms in their entirety. If you do not agree with any provision contained herein, you must immediately cease using the Platform and refrain from creating an account or engaging with our services.

49jil reserves the unilateral right to modify, amend, supplement, or replace these Terms at any time without prior notice. Such modifications shall become effective immediately upon posting to the Platform. Your continued use of the Platform following any such modifications constitutes your binding acceptance of the revised Terms. It is your responsibility to periodically review these Terms to remain informed of any changes.

2. Eligibility and Account Registration

To use 49jil services, you must meet all of the following eligibility requirements:

• Age Requirement: You must be at least twenty-one (21) years of age at the time of registration. This minimum age requirement is mandated by PAGCOR regulations and Philippine law. By registering, you represent and warrant that you meet this age requirement.
• Legal Capacity: You must possess the legal capacity to enter into binding contracts under applicable Philippine law and any other jurisdictions relevant to your location.

• No Prior Exclusion: You must not have been previously excluded, banned, or suspended from 49jil or any other gaming platform due to fraudulent activity, breach of terms, or voluntary self-exclusion that remains active.
• Single Account Policy: You are permitted to maintain only one (1) account on the Platform. Creating multiple accounts, whether under the same or different identities, constitutes a material breach of these Terms and may result in immediate account closure and forfeiture of all balances.

This includes but is not limited to your full legal name, date of birth, valid email address, mobile phone number, residential address, and any other information required for identity verification. Failure to provide requested documentation within the specified timeframe may result in account suspension or closure.

3. Account Security and Credentials

You are solely and exclusively responsible for maintaining the confidentiality of your account credentials, including your username, password, and any other authentication information. You must not share your login credentials with any third party under any circumstances. All activities conducted through your account shall be deemed to have been authorized by you, and you accept full responsibility for all such activities, including bets placed, deposits made, and withdrawals requested.

4. Deposits, Withdrawals, and Financial Transactions

All financial transactions on the 49jil Platform are conducted in Philippine Pesos (PHP) unless otherwise specified. To participate in real-money gaming, you must deposit funds into your account through one of the approved payment methods displayed on the Platform, which may include GCash, Maya (formerly PayMaya), bank transfers via InstaPay or PesoNet, and other methods periodically added or removed at our discretion.

Violations will result in immediate account termination and forfeiture of all funds.

6. Bonuses, Promotions, and Wagering Requirements

49jil reserves the right to suspend or permanently terminate your account immediately and without prior notice if we reasonably believe you have violated these Terms, engaged in prohibited activities, or if required to do so by law or regulatory authorities. Upon termination, all pending bets may be voided, promotional bonuses forfeited, and account balances subject to investigation and potential withholding pending resolution of any suspected violations.

9. Intellectual Property Rights

10. Limitation of Liability and Disclaimers

The 49jil Platform and all services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will operate uninterrupted, error-free, or free from viruses or other harmful components.

To the fullest extent permitted by applicable law, 49jil, its directors, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Platform, including but not limited to loss of profits, loss of data, loss of goodwill, or any other intangible losses, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising from or related to the Platform or these Terms shall not exceed the amount you deposited into your account during the twelve (12) months preceding the event giving rise to the liability, or one thousand Philippine Pesos (PHP 1,000), whichever is less.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

11. Dispute Resolution and Governing Law

These Terms and any disputes arising from or related to your use of the 49jil Platform shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall first be subject to good-faith negotiations between you and 49jil. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration under the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI).

Arbitration proceedings shall be conducted in Metro Manila, Philippines, and shall be governed by the PDRCI Arbitration Rules. The arbitrator's decision shall be final and binding, and judgment may be entered upon it in any court of competent jurisdiction. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

You agree to bring any claims against 49jil only in your individual capacity and not as part of any class action, representative action, or collective proceeding. You waive any right to participate in any such class, representative, or collective action against us.

12. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, processing, and use of your personal information as described in the Privacy Policy.
